What personal data we collect and why we collect it

Protea Wines Japan respects each individual user’s right to privacy. Protea Wines Japan does not collect personal identifying information unless such information is specifically and knowingly provided from users during contests, surveys, sweepstakes, site registration, or use of public areas, such as a forum.

Below is a description of the types of personal data that may be collected, under what conditions, as well as uses of that data.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Contact forms

Contact forms require at least a return email address for us to respond to a user. A user may also include personal information as part of the enquiry. Protea Wines Japan does not store this information, it is only utilized by the contact form software to send an email from the web site to an email address of Protea Wines Japan. Thus, the effect of a user entering a contact form and sending it, is the same as if a user sent us an email, using the contact form as a web-based email client.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. Cookies are small text files that our site places on your computer’s hard drive to recognize repeat users and facilitate the user’s use of the site.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

When you fill out a contact form that has a Google reCaptcha to ensure that you are a real person, the reCaptcha allows Google to set a cookie in your browser and capture information from the browser to help determine if you are a human or not.

Articles on this site may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Mailing lists

Registered users of our E-Commerce site may receive information on products, services, special deals, and newsletters if those users have opted to receive such communication. Out of respect for the privacy of our users, we only send these types of communications if the user “opts-in”.

Opt-in and Opt-out choice

Our users are given the opportunity to “opt-in” to having their information used for purposes not directly related to our site at the point where we ask for information. Protea Wines Japan does not supply identifying information to other companies, or use such information for its own purposes including but not limited to email newsletters, unless the user “opts-in” for such purposes by specifically allowing usage. (Identifying information must necessarily be used when notifying a user of requested information, such as email used for the alerts function, and notification of a winning entry in a contest or sweepstakes.)

Once subscribed, users who no longer wish to receive our newsletter and promotional communications may opt-out of (i.e., discontinue receiving) these communications by contacting us. We may also offer opt-out mechanisms in the text of each email we send.

If a user’s personally identifiable information changes (such as postal code, telephone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users’ personally identifiable information. This can usually be done by the users themselves through their account page, or by contacting us.

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law if we have a good-faith belief that such action is necessary to comply with a judicial proceeding, a court order, or a legal process served on our web site.

On rare occasions, it may be necessary to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance, or there is some concern regarding security, to reassure users or keep them up to date we might send users an email. Generally, users may not opt-out of these communications, although they can deactivate their account. However, these communications are not promotional in nature.

No data is shared with any other party whatsoever.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

Visitor comments may be checked through an automated spam detection service.

Contact form information may be seen by Google as part of anti-spam measures implemented with the use of Google reCaptcha.

Your contact information

Contact information is required for the processing or orders, and communication with users or visitors, and is not shared with other parties.

Registered users may change their information themselves. Note that changes to contact information on the E-Commerce site are governed by PCI-DSS standards, to ensure the integrity and security of user data.

Additional information

Minors

No information should be submitted to Protea Wines Japan by children under 20 years of age without their parent’s or guardian’s consent. Protea Wines Japan does not monitor the age of site visitors. Orders on the E-Commerce website require registration including a date of birth to ensure being above the legal age for the purchase and consumption of alcohol.

How we protect your data

Protea Wines Japan uses reasonable precautions to keep the personal information disclosed to us secure, including use of TLS and server certificates for site access, and compliance with the PCI-DSS standard for the E-Commerce website (such as, no credit card information is ever recorded or stored).

However, Protea Wines Japan is not responsible for any breach of security. If a Protea Wines Japan user knowingly provides personal information, such as a name or email address, in a forum or other public service, that user should be aware that the information provided can be collected and used by third parties. Such activities are beyond the control of Protea Wines Japan.

What data breach procedures we have in place

All our data is backed up regularly, so that any catastrophic loss of data integrity can be limited to the previous backup.

In case a data breach is detected, appropriate action will be taken within 72 hours to discover the cause, effects, and containment.

Users will be informed directly as far as possible, and the known extent of any data breach shared in order to permit users to take responsible action at the earliest possible moment. Any orders which are being processed will be double-checked, and placement of new orders will be halted until the full extent of the breach is known, and counter measures and corrections have been made to ensure that the operation of the website is secure.

According to our procedures, we will also immediately inform the local authorities of a data breach, and cooperate fully with any investigations that local authorities may decide on.

No third parties are involved in this site.

What automated decision making and/or profiling we do with user data

The Protea Wines E-Commerce site has built-in functionality to show users recommended products depending on their order history, and or profile information. Other parts of the site do not make use of any profiling or automated decision-making.

Right to Change at Any Time

Protea Wines Japan reserves the right to change this privacy policy at any time, by posting notice of the existence of a new or revised privacy policy. If we decide to change our privacy policy in regard to the use of user’s data, we will post those changes to this privacy statement on the website, and other places which we deem appropriate, so that our visitors and registered users remain aware of what information we collect, how we utilize it, and under what circumstances, if any, we may disclose it to other parties. We will use information in accordance with the respective privacy policy under which the information was collected.

Changes to the privacy policy which do not change the existing use of user’s data, but merely add or modify descriptively or informatively, will not require special notice.
